Professional guidance for challenging DWP decisions

The Appeal Process: Step by Step

01

Request the PA4

Call the DWP and ask for your full assessment report (PA4). This is the most important starting point — it shows exactly where and why you were scored poorly.

02

Request Mandatory ReconsiderationUrgent

You have 1 month from your decision letter. Write clearly: identify each under-scored descriptor by name and explain the error using your own evidence.

03

Wait for MR Decision

The DWP should respond within 2–8 weeks. Do not stop claiming — you can still receive your current award while the MR is under consideration.

04

Appeal to Tribunal (if needed)

If the MR fails, you have 1 month to appeal to the First-tier Tribunal (Social Entitlement Chamber). This is independent of the DWP and overturns around 70% of appealed decisions.

Common Appeal Questions

How long do I have to appeal a PIP decision?
You have 1 calendar month from the date on your decision letter to request a Mandatory Reconsideration. If you miss this deadline, you can still apply with a reason for the delay and the DWP MAY accept a late application — but it is not guaranteed.
What is the difference between a Mandatory Reconsideration and a tribunal?
A Mandatory Reconsideration (MR) is an internal DWP review of the decision. A tribunal is an independent hearing before a judge and specialist panel. You MUST have an MR decision before you can appeal to tribunal.
Can I still get PIP payments while I appeal?
Yes. If you are already receiving PIP at a lower rate and you appeal for a higher rate, your current payments continue. If your PIP was stopped entirely, you can appeal and payments may be reinstated if you win.
What happens at a PIP tribunal?
A tribunal usually consists of a judge and a medical member. You present your case verbally and through submitted evidence. You can bring a representative or support person. Around 70% of PIP tribunals are won by the claimant.
What should I put in my Mandatory Reconsideration letter?
Address each descriptor individually where points were under-scored or missed. Quote the specific descriptor wording, explain why you believe you should score on it, and provide supporting evidence (GP letters, care plans, your own diary). Avoid writing only 'I disagree' — this almost always fails.
Can I get help writing my Mandatory Reconsideration?
Yes — Citizens Advice, Welfare Rights Services, and specialist charities can provide free support. Our platform also guides you through the process step by step. You do not need a solicitor for an MR or tribunal.
